Severe Weather along the Road to Hana [7/21/18]

Rain storm conditions along the Road to Hana on 7/21/18. Various commercial carriers were recorded conducting hiking activities despite the hazardous stream and flash flooding conditions.  Carriers exhibited in this video hiking at Bamboo Forest Kailua MM6.5 and Puohokamoa Stream are illegally parking and trespassing on private property in addition to conducting commercial activity within sacred sights. The Hāna Highway Regulation is a civil volunteer group and unincorporated not-for-profit organization made up of thirteen board members who are lineal descendants of East Maui.

In observance of your intention to voluntarily participate in the activity of the Road to Hana in any capacity, use of the highway, properties, services and facilities mentioned are thereby released of all liability. You agree for yourself and the members of your family, to best prepare yourself and your family for the scenic Hana Highway by conducting thorough research. You recognize the risks associated with the above described activity and assume full responsibility for personal injury to yourself and if applicable, your family members and further release and discharge Hana Highway Regulation and Hana Community Association for injury, loss or damage arising out of you or your family’s use of or presence upon the properties and facilities of the Hana Highway whether caused by the fault of yourself, your family, or any third parties. You agree to indemnify and defend Hana Highway Regulation against all claims, causes of action, damages, judgements, cost or expenses, including attorney fees and other litigation costs, which may in any way arise from you or your family’s use or presence upon the properties and facilities of the Hana Highway.  You agree to pay for all damages to the properties or facilities of the Hana Highway caused by you or your family’s negligent, reckless or willful actions. Any legal or equitable claim that may arise from participation in the above shall be resolved under Hawaii law.
